Hello fellow Bloggers!

This is the fifth of eleven installments of:

"How to Be A Real American"

 

That's right, we are discussing Our Bill of Rights (YOUR RIGHTS!).

 

Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

 

This amendment brings up several interesting ideas.  Most of us have heard of "Double Jeopardy" where a person may not be criminally tried twice for the same crime.  It speaks of military justice, as opposed to civil justice.  And it speaks of the right to be properly compensated for the loss of property for public use.

 

To me, the most interesting topic is "nor shall be compelled in any criminal case to be a witness against himself".

 

This seems contrary to the way many cases are handled today.  The criminally accused are often bribed with lesser sentences if they will "just confess" to doing something wrong.  You can plead the fifth, but you do so at your own peril.  You can claim innocence but you do so at the risk of harsher penalties.  Although I would agree that criminals should confess, and that some leniency might be applied to those who do confess, I find it disturbing that the public is told they should plead nolo contendre or guilty just to avoid the consequences of trying to get a fair trial.

 

What say thee?  Doth The State treateth The People justly?

Is there such a thing in this world as innocent unless proven guilty?

This day and age your guilty unless your rich enough to prove yourself innocent.

Well, don't even get me started on this one!

I will address the last: nor shall private property be taken for public use, without just compensation. Far too short!
How about taking private property, and selling it to a private enterprise? What could possibly be just compensation?
I am of course referring to the seizure of private property here in Daytona, specifically the boardwalk. Where the city forced all the owners to sell, and promptly turned thier propertys over to a private developer!
I was shocked! The state has since passed a law against this, but the dirty deed was done before it passed!
They intend to replace the boardwalk with 2 skyscrapers, of 20 storys each. The city, so very greedy for more revenue, bulldozed people out of businesses that were handed down for generations. No compensation would be just.
Worst of all, this project might not even go through. With a glut of condos, and a slow economy, amidst other complications, the city could see this developer pull out.
In the meantime, they have torn down most of the boardwalk and surrounding propertys, and it is just a mass of barren, crudely fenced empty lots. And will probably stay that way for a long long time, if not forever.

They have destroyed the heart of Daytona Beach, and for nothing. I do not believe these monstrositys will be built, and the many familys that have been coming here for years, for generations, will cease to come.

If you build it, they will come.
I say:
If you tear it down, they will cease to come.

You had to get me started on this! LOL!

This is the reason why people would do the nolo contendre, there is a great chance, going in front of a judge could make it worse. You try to tell a Judge your side of events, meanwhile he is schmoozing the stenographer, and not listening. County bumpkin Judge is too stupid to multitask and is not listening to you. You get a charge of guilty even when you are innocent. :( grrrrr!

I like sharing ideas and ideals in an open forum. I may not like what you have to say but you can still say it here. I try to be fair. I'll often admit that the positions I support have flaws. I detest bloggers who always base their opinions on their political party's rhetoric and never have an original thought. I am neither a Republican or a Democrat. I vote for whoever I think will do the best job of running things. I may be wrong but at least I think with my own brain. I am looking forward to seeing an open debate between Obama and McCain. I think Obama will whip McCain so badly that you wouldn't believe it. I think Rush Limbaugh is the biggest and most dishonest jerk that ever lived. John "New Orleans Deserved It" Hagee is somewhere right alongside him. If you like Limbaugh or Hagee then you're ignorant and you suck. Whatever you think, join the blog! Come and debate! Let the politicians know what the public really thinks on an open forum like mine where free speech cannot be denied!
