WASHINGTON - The Supreme Court rejected a challenge today to San Diego County's practice of routinely searching welfare applicants' homes without warrants and ruling out assistance for those who refuse to let them in.

The justices refused, without comment, to intervene in the case from San Diego County, where investigators from the District Attorney's Office show up unannounced at applicants' homes and conduct searches that include peeking into closets and cabinets. The visits do not require any suspicion of fraud and are intended to confirm that people are eligible for government aid.

Failure to submit to the searches, which can last an hour, disqualifies applicants from assistance.

The 10-year-old program was challenged by the American Civil Liberties Union on behalf of six single parents who were seeking assistance. The welfare applicants argued that the Fourth Amendment, which prohibits unreasonable searches, protects them from the home visits.

"When the investigator conducts the home inspection, no part of the home is off-limits," they said.

The 9th U.S. Circuit Court of Appeals, upholding the program, said the Supreme Court in 1971 allowed social workers to visit homes in New York to determine eligibility. The appeals court, in a 2-1 decision, said the visits do not even constitute a search under the Fourth Amendment in part because people are free to turn away the investigators.

In dissent, however, Judge Raymond Fisher said it was unlawful for an investigator from the district attorney's office to go "walking through the applicant's home in search of physical evidence of ineligibility that could lead to criminal prosecution either for welfare fraud or other crimes unrelated to the welfare application."

Well we all voted for cleaning up waste, fraud, and corruption in our government didn't we? The mandated (according to Democrats) for real change?

They should be entitle to have these investigations perhaps IT WOULD STOP ALL THE WELFARE FRAUD...I know lots of people back in Jersey on freaking welfare HEALTHY FFF PEOPLE THAT CAN WORK BUT THEN THEY HAVE SCUM DOCTORS SAYING THEY ARE DISABLE AND/OR THEY MAKE THEIR CHILDREN DISABLE...........SUCH A CROCK OF BLEEP...they take the welfare money and buy alcohol and drugs and/or with the fathers of their children sometime even married but keep their maiden name..........I have fought this for year TO NO AVAIL...LAZY ASS COUNTY WORKERS..get pay for doing nothing...yet those in need of it...get all the grief......DEMOCRATS MY ASS.........THAT'S WHY I HAVE CHANGED TO REPUBLICAN..........SICK AND TIRE OF DEMOS LIES AND NO ACTION.......

If these were Investigators from the housing authority I would be in full favor of the program. However to let someone from the District Attorney's Office have free acess to your home is Idiocy on your part.

There are literally hundreds of laws on the books, no matter how hard you try you can not possibly be in continuous compliance with them all.

The chance of some overzealous district attourney filing charges on something they dig up is just to real to give up the protection of requiring a judge to issue a warrent for a search based on credible evidence there is something to find

It's one of those things to where if you insist on acting like a child and forcing the rest of us to pay for you, then you are to be treated as a child. I wish they would make it so very uncomfortable for those on "government aide" so that they decide to do something positive with their lives, because the alternative is just too tough to live with.

I am 100% in favor of random inspection of welfare recipients homes. When they sign on the dotted line asking for welfare, they should be made aware of these inspections or visits. These people are using my money to survive and I want to be assured that this money is going to someone deserving. There are far too many of those low lifes sucking off the system already. I would love to nail those freeloaders. I can't afford the bling or groceries I see them with and it's my money that is supplying them.

When I drove a schoolbus for head start we worked with low income families! I knew too many so called single parents on welfare with boy friends living with them! They had really good jobs! One parent had a new BMW her boyfriend gave to her but kept in his name so welfare wouldnt know!

Honestly, should welfare mothers be allowed to do that? What specific 'right' is this?

If she doesn't like it, let her get off the drugs, slide a spatula under her butt and get a jobn at Wal Mart.

You said it Frank , fact is that the “crime rate” in welfare community (ALL recipients) is high (better than 80%) ...not searching the homes of welfare recipients is in fact federally subsidizing crime. It would make perfect sense to search with out notice the home of any one who asks for help from the government. ...fact is that not being able to pay your own bills is a very VERY large indication that you are in fact spending a large portion of your time doing something other than working.

This would mean anyone who recieves Unemployment, Social Security, Federal Drug Programs for the Elderly, Anyone who receives Medicare and Medicaid would have no rights to privacy in their homes. That sounds like we may need another Government Agency to Oversee this new "law".

@Riley34470: Correct. If you're draying unemployment, you have to provide information periodically that you are still unemployed, have been making good faith efforts to obtain employment, and are still eligible for unemployment compensation. Failure to do so automatically stops that compensation. It's in the rules for collecting unemployment compensation.

Social Security? Yep; to keep getting the amount you're eligible for, every year you have to reaffirm that your other income doesn't exceed the allowable amount. If it does, your Social Security monthly checks gets lowered. It's in the rules for drawing Social Security.

Same thing for drug programs, medicare, and medicaid. Periodically, you are subject to review/confirmation of continued eligibility. It's nothing new; maybe the STRENGTH of enforcement is new, but with chopped budgets and more and more families falling into/below the poverty level and seeking eligibility, efforts have to be made to keep the fraud to a minimum.

You want something? Comply with the requirements for receiving that "something." Don't like the rules? No problem; you don't get the "something."

I understand what your saying and I respect your opinion. Do you believe that the Drug part should be across the board to all Government Aid Recipients, or should it just be for one specific Group of Recipients? If you're on welfare they should not only check on you but make you stop spitting out children as well. Why is it that welfare people keep having children? Is it that they aren't working and there is nothing else to do or because the more head count the more money? Or both. They really need to regulate the birth rate in some of these families. If young girls at school can get the pill for free then so should welfare couples.

Ziggy, a very good point. I have ranted about this for years. If one starts getting welfare with one child, they should not get anymore money if they have more while on assistance! Doesn't that encourage those that cannot support the one, to have another to get a "raise"? Then another, another, etc.
There is something inherently wrong with this policy!

now you pay into social security for 50 years its not a give away thats supposed to be there in cause you become disabled or retire its not welfare its something we paid for and the govt been stealing from i for one paid both sides for years and i have plenty of drugs i spend about 2100 a month if i bought them here a lot cheeper getting them from canada

Ziggy and Frank, I agree with you wholeheartedly! This really needs to start to be on the political platforms more. It really ticks me off. My husband and I stopped at 2 kids because it is all we can/could afford. It really gets to me when I see others be so irresponsible.

i see no problem with this you are living off the govt. just like being in the militaty you are govt property. i think they should take this even one step further. since us working stiffs who are providing the taxes it takes to pay these freeloaders have to pass a urine test to get a job or if we get hurt on the job have to pass in order to collect workmans comp that these people sitting home should have to take the same test. if i have to pass a drug test to go to work why should these people be permitted to sit home and buy drugs with our tax money

Good point stroke! They should be giving piss tests to those who place a claim for unemployment! But there are those who do use the system for their personal lazy gain. To search someone's personal property and home should only be conducted if they have probable cause through the DA! If there is any kind of question or dought of any applicant then a drug and alcohol test would build a stronger case and give probable cause for full inspection but this should not be forced upon everyone. That is like placing the innocent within the same category as the guilty! They need to find that better means of recognizing the difference between the two which would give them a stronger legal means of actions to follow!

i guess your right about the search, but i still think the piss test shuold be manditory for all living in the home over the age of 14, one person fails they all lose, might even help with the drug problen,, do drugs no more free money

you people are nuts social security is not a govt give away you have to pay into it its not wefare and kids or anyone else who didnt pay in shouldnt get it if a kids parent who paid into the fund dies then the kids covered and social security donst have right to come into your home you just have to report any earnings and keep paying- now the govt has been using(stealing from) the fund for years to pay for all kinds of programs and one more thing the rep tax break at 96500 should be repealed any one that make that much can aford to pay the tax

Wrong.. Social Security right now is being snatched up by our government from all those illegals who technically if they were here long enough could not recieve it without a Social Security number. (The reason seasoned and left wingers like illegals...)

I own a home at age 44, my neighbor owns their home at age 65 and gets a waiver for her property taxes because she is on a fixed income? Im retired too! Thats nothing more than age discrimination! I can no more afford my drugs than she can! And I have to pay taxes!

Don't give me the senior deserving crap either. It is they who continued to vote and re-elect those who have been stealing Social Security blind for decades! They say we need to protect our children's future.. yea.. I know why! THEY are the ones that will be feeding and keeping you in medicine instead of putting that money into their own children's futures!

incase anyone of you dont know this . on 60 minutes a little while back there was a segment where they ststed that 86000 imigrants a year are on a waiting list to come here and collect social security without ever having paid into it, i cant see why it takes a rocket scientist to figure out what is wrong with the system and why its going broke, the only way to fix the system is to make congressman and all other politicians use the same system as the rest of us instead of the plush system they set up for themselves

I hurt my back in 1998, owned my own home(well,me and the bank),I worked 2 jobs, going to college full time and did it all on my own with no help from anyone. After I hurt my back, I went 4 months with no income. Needless to say, everything I busted my ass to get, I was in the process of losing. I called my mortgage company. No help there. In the mean time, got fired from my job because I couldn't work(got hurt on my full time job). I tried collecting unemployment. No help there because Discount Auto Parts said I abandoned my even though they knew I herniated 2 disks in my lower back and 1 in my neck. I was getting desperate. Well, I was trying any avenue I could think of and dealing with severe back pain like I still do today because I was in danger of losing my home. I went to the Salvation Army and without too many questions, they helped me with my bills and one house payment.

To continue, I went on down to my friendly Welfare office and it wasn't until then that I found out I was fired from my full time job. With my back pretty much broken and sitting in the welfare office which I was really embarrassed to be there, I asked if I could get help with my house payment. The man behind the desk looked at me like I was dirt because I was asking for help. And proceeded to ask me if I had any kids(I said no), He asked if I was pregnant(I said no)and he said the only thing I could get was food stamps. As if I wasn't broken enough! I certainly didn't want to be there. And since the guy snidely said all I could get was food stamps, I had to ask him(is it because my skin is the wrong color?) He actually said yes. He was a white guy. But I tell you that when I went out to the waiting area would you believe what I saw?

I saw black girls with their nails done, weaves in there hair, gold teeth, gold around their necks, fancy clothes and a social worker that actually came out to the waiting area and called one of these girls names real upbeat and happily is the only way I can say it. When the guy called me in he sounded like I was wasting his precious time! And also in the waiting area I saw one white girl with 2 kids that looked like they didn't have anything. And to my surprise(not really) when I went to get in my car and leave, I observed in the front parking spaces 1 new Cadillac, 1 almost new BMW, 1 Lexus and a poor sad looking Pontiac (early 80's model) with 2 carseats. I bet it belonged to the white girl. Anyway, sixty-six and two-thirds percent of my average weekly wage wasn't much to live on as workers comp goes. And It took workers comp 16months to approve my first back surgery. So, disability and so-so security sucks since my settlement wasn't a whole lot(my lawyer sold me out) so life is kinda hard but I will never go on welfare again and no I'm not sponging off the system.

But I do think that Welfare should have every right to pull a surprise visit on these people that know how to "Abuse the system" as you know exactly who you are. See if they have a BMW or a Lexus or new Cadillac in the driveway. And walk in to see if there is a crack pipe laying around and to see what kind of treatment the kids are getting. Like I said, the welfare caseworker said I wasn't the right color.
