Immigration mess is Congress' fault

In the wake of a violent crime spree that authorities say was the work of three illegal immigrants, U.S. Rep. Ginny Brown-Waite is asking a reasonable question about why the alleged ringleader was previously released from custody. But to ask "who dropped the ball" with deportation is to point the finger back at Congress. This is a problem of staggering dimensions.

Just look at the numbers in Hillsborough County alone. Last year, jail officials notified Immigration and Customs Enforcement of 11,930 adult and juvenile inmates who were born outside the United States. ICE responded with retainers for only 700. Of those 700, jail officials don't know many were picked up or deported.

"This is an issue a lot of sheriffs across the nation have been screaming about," says Hillsborough Sheriff David Gee, "and I don't think people get it. ... If you don't do a better job on the border, in the meantime you're going to have these collateral issues that are going to be very difficult to control."

In this case, St. Petersburg police had targeted Rigoberto Moron Martinez, 20, as a suspect in an Aug. 3 robbery and rape at a downtown restaurant. Hoping to get a DNA sample, they asked Hillsborough deputies to pick him up for failure to appear in court for an old domestic violence charge. Martinez was released on bail on Aug. 6, after spending only five hours in jail. Ten days later, say sheriff's officials, Martinez and two accomplices raped and robbed two women in Apollo Beach.

The three men are now in custody, and miscommunication between St. Petersburg police and Hillsborough deputies seems to be a contributing factor in this tragedy. But Brown-Waite, a member of the Homeland Security Committee, is raising the larger issue of immigration enforcement: If ICE can't keep up with all the estimated 12-million undocumented immigrants, can't it at least put the clamps on the ones who are thrown in jail?

In ICE's defense, Martinez was booked on a misdemeanor, not a violent felony. But that is little consolation. The reality is that ICE has neither the manpower, the technology nor the inclination to begin deporting illegal immigrants who are arrested by local law enforcement.

In turn, most local law enforcement agencies don't have the database access or training to determine whether jail inmates are in fact illegal immigrants. (As one expert told the Times: "I've been an immigration lawyer for 25 years and sometimes I can't figure out someone's immigration status.")

In other words, Martinez didn't really walk free on Aug. 6 because someone "dropped the ball." The ball was never in play to begin with. Brown-Waite wants answers, and she deserves them. But she and her congressional colleagues need to be willing accept the whole truth. When ICE can't even deal with illegal immigrants who land in jail, immigration law becomes a parody.

I'm telling you just plant land mines on the US side of the border of course (otherwise they will SCREAM discrimination). Then to help raise money to pay these brave men and women that are our border patrol agents make it a pay per view!

I say we get a giant catapult and place it on the gulf coast. That way, we can at least try to send them back to Mexico.

I love the catapult idea. I will buy and donate the land if it is placed along the gulf coast of South Florida. Can anyone advise if there is a season on sharks in the gulf? That is just in case they fall a bit shy of the Mexican border.

I live in Colorado and did not realize that states on the east coast had problems with illegal Mexicans. We do but not as bad as Arizona. They must have money to travel that far. Most of the police here do not notify anyone if they have an illegal, they just turn them free, not that they want to but there is no help to do anything with them. We have a problem with crimes committed by them like the police officer that was killed behind my daughter's car while she was out dining or the woman that was dragged behind a car for 2 miles, both were done by illegals and did not face a death sentence or life in prison thanks to the Mexican government.

As long as the numbers stay in the range of
11,930 people reported to ICE after arrest and in jail( And for ONE COUNTY FOR ONE YEAR don't forget).

With only 700 Federal holds issued. We get a difference of 11,230 with no Federal action taken.

Nothing you do to increase arrests will help at all it will only increase the no action taken number

Do not think I am against action against Illegals I just want to make the situation clear, it is the Federal Goverments ICE dept that is failing us and endangering us

The easy solution to the Illegal Immigrant?
Fine companies that employ them $10,000.00 for each illegal. Then they,the companies,would find it cheaper to pay and employ legal Americans a fair wage for the work.
According to Obama, ICE is just a terrorist group.

...Did you catch any of MSNBC's stories this week about how “hard” it is on illegals when they do get deported ? If was fun in a number of ways , did you know that is an illegal is apprehended in a raid and they are under 18 they do not face deportation ? If an undocumented individual claims to be under the age of majority they are placed in a federal program called : Refuge relocation and they will be awarded citizenship and public assistance . ...ain't it great. The federal government is at the heart of this whole problem and has far more programs and regulations in place to keep illegals here than any effort to keep them out , in fact we spend more “helping” and “naturalizing” illegals than we spend trying to enforce the law.

You can't point the finger at ICE alone, in most cases : Texas, Arizona, California, Arizona, Florida, Colorado , Mississippi (and others but this is a list of only the ones I have checked) “local law” has asserted its dominance over Federal law in the case of illegals RE: ICE can not take direct action with out giving local courts a “first pass” at any one detained . You will find that will the details vary from place to place the results are the same nation wide , federal agents capture illegals and are forced to place them in custody of local law enforcement local law enforcement releases them.....its all part of the Liberal courts idiotic concept that every one every where has a right to a day in an American court.

But David you are not taking into account the “other” opinion on this subject, the one that blames us for not giving enough imigration slots to Mexico, the one that all Liberals suport , that we can fix this situation by naturalizing ALL illegal imagrants (Hispanics ONLY that is, other countrys need not apply) . LOL
To the guy that is blaming the “bosses” get a clue, the people who are stealing jobs and money from this country MOST often provide “documents” that are hard to verify and IF you push you can and will get sued....Fun Fact : you can lose a legal battle in this state if you refuse to emloy an individual who fails to identafy themselves, RE: you can be sued by an illegal imagrant and his/her legal status in this country will NOT be taken into account in the law suit...but go ahead blame the buisness owners for a MESS that liberals in our government and our court system have created delibretly to benafite their pet party!

I dont like disagreeing with you but I stand by my argument.

If 11,230 arrested subjects out of a total of 11,930 are not only not deported after being reported to ICE but are not even acted upon by that agency in any manner at all, Then it is ICE not local goverment that is failing to do thier jobs and endangering us and our families.
Remember this is for one county alone for one year only.

Local goverment did thier jobs by arresting them and reporting them to ICE

Elected public officials, when sworn into office, swear to abide by and uphold the laws of the land. They freely sought these positions of GREAT responsibility in goverment and PUBLIC service. Failure to abide by their FREELY given oath should result in termination of both job and life ! AMEN !!!

I do blame the bosses and the legal system, in this case how come they (ICE) new all these illegals worked at this factory but the bosses didn't. Come on, lets get real its cheap labor. All the time we allow them to claim we didn't know with no punishment it will continue. We have laws lets inforce them. I know people in Europe well educated that would love to live here. They are refused entry,guess if they swam over they could stay.
