Remember Joe Woodard?

His wife and daughter were killed last year when a plane crashed into their home in Sanford.  His house - also destroyed.

Well.. Mr. Woodard rebuilt his home.  It's a few weeks from being completed and the HOA is now telling him he might have to tear down the house because he is breaking some rules.

The HOA told him the shingles and the elevation of the home are not consistant with the community's.

Talk about another battle Mr. Woodard is trying to over come!

What do you think?  Should he have to tear down the house and start over?

Should the HOA make an exception?  Could there be a compromise?

The HOA board is heartless and needs to be kicked to the curb. I hope the residents of that community petition together to remove the current board AND allow the widower, Mr. Woodard, to keep his rebuilt house intact. That should shut them up.

He needs to tell that HOA to stick it where the sun dont shine. To build or rebuild a home you have to have plan that are approved and since the construction is almost complete then the plans were approved.

I'm sure these aren't new rules. Why would someone build a house without making sure they were obeying the rules? If he were breaking fire codes or any city law you can bet he'd be forced to stop.

I feel for the guy but that doesn't mean he should be given a pass.

Didn't he submit a copy of the plans to the HOA? If he did not, it is his own fault.
If he did, and they didn't say anything until the house was built, he has a good case for a lawsuit that he will win.

Rules are rules, and everyone has an excuse for not following them.

How about all of the seniors in gated communities whom are losing their home to foreclosures and are also not paying their HOA dues because of hardships. Should the HOAs and mortgage companies also make exceptions for these people?

Gee - I thought this guy was an American with the right to do what he wants with his own property.

If his house were in the shape of a giant middle finger or he wanted to paint it school bus yellow with a purple roof, then MAYBE he has a problem.

But he's been told here that that house has to be EXACTLY the way it was before. Since when did ANYONE have that kind of power?

If he's looking for someone to man the picket lines with him, I'm there.

House of Management Enterprises and their attorney refused to comment about the situation.

Well…Let the pinheads know what you think!

While he never in a million years expected what happened, rules are rules and he signed off on them when he purchased there. Or, if that doesn't work...MOVE. And as far as exceptions, what a moronic statement. Do for one, have to do for all or face a BS lawsuit.

And Liz 'ol girl, "overcome" is one word when used in that context. Moron...

Another reason not to live in a neighborhood with an HOA.

The man's a widower, not a widow. A widow would be a woman. Just a tip for someone that's supposed to write for a living?

Had he been new to the neighborhood, their might be an explanation for this issue...but, having resided in, and being exposed to the rules...there's no excuse. The news wants to play the sympathy card for him, and what happened was tragic, however, if he wants a bigger house, move!

It sounds to me like this person wanted all the perks of living in an HOA community. Now he wants to have his cake and eat it too. Wizard who said it is an American right to do anything you want on your own property? Might I also point out that this is not his property. By buying in a HOA community he signed away some of those rights in exchange for certain benefits. Now he wants the benefits and the right to break his end of the agreement. To me this sadly sounds like the New America.

To imagine no one caught this before construction is ludicrous in the extreme. I think he gambled and lost,

I think HOAs are just a bunch of snobs who love telling people what to do. If they don't like it, than they should just build it for him. He doesn't want to leave the home where he spent happy times with his family.
