WASHINGTON-  The Supreme Court on Monday turned down a plea by environmental groups to rein in the Bush administration's power to waive laws and regulations to speed construction of a fence along the U.S. - Mexican border.

Homeland Security Secretary Michael Chertoff has used authority given to him by Congress in 2005 to ignore environmental and other regulations to move forward with hundreds of miles of fencing in Arizona, California, New Mexico and Texas.

The case rejected by the court involved a two-mile section of fence in the San Pedro Riparian National Conservation Area near Naco, Arizona. The section has since been built.

As of June 13, 331 miles of fencing have been constructed in the afore mentioned four states.

"I am extremely disappointed in the court's decision," Rep. Bennie Thompson, D-Miss., said.

Thompson chairs the House Homeland Security Committee. He and 13 other House Democrats filed a brief in support of the environmentalists' appeal. 

Russ Knock, a spokesman for the Homeland Security Department, said: The American people expect this department to enforce the rule of law at the border. He added that the department is happy with the courts decision.

Simple solution, install lasers at the borders then implant ALL illegals caught with a laser triggered implant that will explode if they try to cross the border and inform them that if they try to remove it, it will explode as well.

Seriously, I am in favor of this fence but I have to wonder if we are fencing them in or out? While it will make it harder for them to get in, we are still faced with the millions that are here and sucking the country dry.

Forget the stupid fence! The will go around it anyways and get in. As long as there are jobs waiting for them.....they will come! We need to empower our border patrol and not put them in prison for doing there job. We need to put land mines down there at the border.

BTBW: any idea on how many they are going to hire? And does anyone know if it still going to cut off some US land?

IMO I think thats the only thing thats going to work,people. Existing fences can have up to 10 people cross in less than a minute and these high tech ground sensors have been said to fail or send false triggers.. You send the guards out there and theres a dozen crossing somewhere else.

I was always partial to the land mine idea.

But I think a nice tall reenforced concrete wall (say 15 foot tall and another 30 foot buried in the ground would do the trick.
Have sensors in the wall that detect vibrations from digging and we're all set.

Fences are nice, but it's not like they can't cut them and go through anyway. More guards a good idea. Tougher fines on employers who hire illegals, much better! I say if someone knowingly employs illegals, they should have their business license revoked, pay fines, and pretty much need to be homeless.

Fences offer a false sence of security.. It's merely a way to appease the public, as another poster has said "The fences can be cut".

Now if razor wire where placed at the top and bottome of the fence. It would add a deterrent factor to the mix, or electrify it would add another level of security....

I am with Gammies here...fences are the first step but we need to address the problem we already have and start enforcing the laws and removing those that break them and that includes those that do the hiring!

Lets see...2100 miles of border and only 700 miles of fence. Yeah, thats gonna work. Who got the contract to build it, Haliburton? Enforce the laws we have against hiring illegals, end all welfare type benefits for them. They will not come if there is no money. Then let the miltia-types patrol. The good old boys will keep them out.

Well, I think they need to finish the fence and then some. I agree with you TavaresJim, we need the fence up AND get tougher on laws regarding illegals here in the US.

Also, why is Puerto Rico only a territory (or whatever)? They get to vote so why do they not have to pay taxes!!! They are considered part of the US. I work in a school and the majority of the students are spanish and on low income. However, they fly back and forth to PR 2-4 times a year, they have free lunches, qualify for every government assistance program there is, but yet they don't pay taxes.
Why not make PR a state and make them pay like you and me!!!

I saw something on the news the other night about the recruitment of Border Patrol Agents going on right in Orlando. What we need out there, besides a big-assed, electrified fence at 25,000 volts is MANPOWER, with high powered rifles that are meant to KILL, not bounce off intruders. Are we through friggin' around with these people, OR NOT? If we are, then we need to get serious about it, right now!

Great post Frank ! A large majority of the American people think it should be done both to HALT illegal immigration and for National Security to prevent TERRORISTS that same avenue for entrance into America. Three additional positive side effects are : HALTING some of the illegal DRUGS, HALTING VIOLENT CRIMINALS and GANG-MEMBERS, and slowing the unrestricted HEMMORAGING of SS Funds stolen from Americans and GIVEN FREELY to illegals. As far as the politicians, I could have sworn that when they were SWORN INTO OFFICE they agreed to ABIDE BY and UPHOLD the LAWS of the land. Could I possibly be wrong ?

Your are 100% correct with the Ricans. My wife used to work at a school that also had a big PR population and 99.99% of them got free lunch yet when the parents picked the kids up from school it appeared they were making their nice car/truck payments just fine. They also seemed to take showers everyday and wear new clothing to school.....so why must I pay for your kid to eat lunch everyday??? By the look sof most of the kids they were not missing any meals at home.
